How Does a Texas Personal Injury Claim Work?

Every case is different, but most injury matters move through several recognizable stages.

Investigation and coverage

The legal team identifies parties, preserves evidence, obtains reports and video, evaluates liability, and requests applicable insurance information. Urgent deadlines and potential governmental notice are addressed first.

Medical development

Treatment decisions belong to the client and medical providers. The claim is developed using records, bills, diagnoses, imaging, restrictions, prognosis, prior history, and evidence of how the injury affected work and life.

Demand and negotiation

When the claim is sufficiently developed, a demand may present liability, injuries, damages, and supporting materials. The insurer evaluates coverage, fault, causation, and value. Negotiations can continue before or after suit.

Litigation

A lawsuit may involve written discovery, subpoenas, depositions, experts, motions, mediation, and trial preparation. Filing suit does not guarantee trial; many cases resolve during litigation.

Every case turns on its own facts.

Deadlines, insurance, available parties, and proof can change the analysis. A website cannot determine whether you have a claim.
