What Does “No Fee Unless We Win” Mean?

Many personal-injury firms use contingency-fee agreements, but clients should understand the written contract rather than rely on a slogan.

Attorney fee

The agreement should state the percentage or method used to calculate the attorney fee and whether it changes if a lawsuit, appeal, or trial becomes necessary.

Case expenses

Expenses can include records, filing fees, service, depositions, experts, investigators, demonstratives, travel, and medical summaries. The contract should explain who advances expenses and how they are repaid.

Medical balances and liens

A settlement may require resolution of health-plan reimbursement claims, Medicare or Medicaid interests, hospital liens, provider balances, letters of protection, child-support liens, or other obligations. These amounts are distinct from the attorney fee.

Settlement statement

Before distribution, the client should receive a written settlement statement showing the gross recovery, fees, expenses, payments or holdbacks, and the client’s net amount. Ask questions before signing.

Deadlines, insurance, available parties, and proof can change the analysis. A website cannot determine whether you have a claim.
