Can I Recover If I Was Partly at Fault in Texas?

Texas generally uses proportionate responsibility, meaning fault can be divided among responsible people or entities.

Percentage of responsibility matters

A claimant’s recovery may be reduced by the percentage of responsibility assigned to that claimant. If the claimant’s percentage exceeds the statutory threshold, recovery can be barred. The precise application depends on the claims and parties.

Fault is evidence-driven

Police conclusions, citations, video, photographs, electronic data, witness testimony, physical damage, policies, and admissions can affect allocation. An insurer’s early percentage is a negotiating position, not necessarily the final legal answer.

Multiple actors may be included

Responsibility may involve more than the two people immediately involved. Employers, property controllers, contractors, product companies, or other designated responsible parties may affect the analysis.

Avoid premature admissions

Give truthful facts, but do not fill gaps with guesses. Statements such as “I should have seen it” can be taken out of context when lighting, obstruction, warnings, timing, or another person’s conduct has not been investigated.
